2. The petitioner has preferred this application for grant of regular bail in connection with Sarai P.S. Case No. 87/2025 dated 19.04.2025 registered for the offence punishable u/ss 8(c), 21(b), 25 & 29 of the N.D.P.S. Act.

3. As per the prosecution case, total 15.06 grams Smack (Heroine) including pot was recovered from the possession of the co-accused persons. No any article has been recovered from the possession of the petitioner and the coaccused, Om Prakash.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.45466 of 2025(3) dt.15-09-2025 2/2 this case. The name of the petitioner has sprung up in this case on mere suspicion. It is further submitted that the petitioner was not involved in the illegal offence. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 19.04.2025. The co-accused person has already been granted regular bail by this Court vide order dated 18.08.2025 passed in Cr. Misc. No. 47563 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Vaishali at Hajipur in connection with Sarai P.S. Case No. 87/2025.

7. The application stands allowed.
