The petitioner seeks bail in connection with Gopalpur P.S. Case No. 478 of 2020 dated 18.12.2020 instituted for the offences under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner has been named along with seven accused persons with the allegation of having fired upon the deceased resulting in his death.

The deceased has suffered three injuries.

Patna High Court CR. MISC. No.49415 of 2022(3) dt.22-12-2022 2/2 The learned counsel for the petitioner has submitted that though the petitioner has been named in the F.I.R. but, there is nothing specific in the accusation and he is in custody since 11.03.2022.

Under similar circumstances, one Jaggan Yadav has been granted bail by a Bench of this Court vide order dated 07.11.2022 in Cr. Misc. No. 2527 of 2022. Regard being had to the aforenoted facts and taking into account that the petitioner does not have criminal antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Naugachiya, Bhagalpur in connection with Gopalpur P.S.
