2. The petitioner apprehends his arrest in connection with Banka P.S. Case No. 697 of 2023 registered for the offences punishable under Sections 341, 323, 504, 506, 324, 308 of the Indian Penal Code.

3. As per prosecution case, when the informant was taking food then the petitioner who is the younger brother of the informant came there and started abusive word due to land dispute and when the informant protested the same, the petitioner gave farsa blow on the head of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to land dispute. Petitioner and the informant are

Patna High Court CR. MISC. No.51002 of 2024(2) dt.31-08-2024 2/2 admittedly full brother belonging to same family and in scuffle, only simple injury has been caused to the informant and the injury report does not support the allegation of the informant against the petitioner. Petitioner has one criminal antecedent. Petitioner undertakes to cooperate in the investigation and trial of this case.

5. Learned APP opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Banka P.S. Case No. 697 of 2023, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
