The petitioner is languishing in custody for the offences punishable under Sections 364A/302/34 of the Indian Penal Code.
The minor son of the informant was kidnapped and subsequently murdered allegedly by two persons named in the FIR. The petitioner is not named in the FIR. The name of the petitioner surfaced in the confessional statement of co-accused . Petitioner is in custody since 29.12.2018. Investigation of the case is already complete. Co-accused Nagendra Paswan @ Nagendra Kumar Paswan has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.39773 of 2019.
Patna High Court CR. MISC. No.44270 of 2019(2) dt.19-07-2019 2/2 Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kurtha (Manikpur) P.S. Case No.229 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
