The petitioner seeks bail in Bihpur Rail P.S. Case No. 05 of 2019, instituted for the offence under Section(s) 379 and 411 of Indian Penal Code.

It is alleged in the written report that petitioner has been apprehended on Narayanpur Railway Station from Sleeper bogie of Mahananda Express. One Mobile Phone has been recovered from his possession.

Counsel for the petitioner submits that petitioner has been arrested merely on suspicion. There was no complaint that the said Mobile is stolen one. He further submits that aforesaid Mobile belongs to the petitioner.

Patna High Court CR. MISC. No.43944 of 2019(2) dt.19-07-2019 2/2 Petitioner is in custody since 19.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Khagaria, in connection with Bihpur Rail P.S.
