====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-04-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Goraul P.S. Case No. 180 of 2020 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The prosecution case is that the informant Jainab Khatoon had submitted a written application before the officer in charge of Goraul Police station alleging inter alia that her daughter Sanjida Khatun was in love with Md. Pravez son of Md. Islam and both of them were ready for marriage, but father of Md. Pravez namely Md. Islam was not ready and two days back, he along with his entire family gave threat to kill. In the meanwhile, Md. Islam and his three sons killed her daughter by strangulating her neck and hanged her by wrapping dupatta around her neck.

Patna High Court CR. MISC. No.926 of 2021(3) dt.05-04-2021 2/2 Learned counsel for the petitioner submits that the petitioner is quite innocent and has falsely been implicated in the present case. The petitioner has been made accused along with all the male family members without any specific allegation only because he is own brother of Md. Pravez, with whom allegedly the informant's daughter was in love and wanted to marry. There is general and omnibus allegation against all the five named accused persons and there is nothing specific against the petitioner. There is no eye witness in the present case. Only on suspicion, the petitioner has been made in the present case.

Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Vaishali at Hajipur in connection with Goraul P.S. Case No. 180 of 2020.
