JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-10-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner apprehends his arrest in Saharghat P.S. Case No. 32 of 2022, registered for the offence punishable under Sections 272, 273, 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act. 13.2 litres of illicit liquor and 5 liters of beer has been recovered from the motorcycle of this petitioner. It is submitted that nothing has been recovered from conscious possession of this petitioner. The vehicle in question was used in transporting illicit liquor without knowledge and consent of this petitioner. Petitioner claims clean antecedent. Counsel for the State vehemently opposed the bail application and submitted that illicit liquor has been recovered

Patna High Court CR. MISC. No.46204 of 2022(2) dt.21-10-2022 2/2 from motorcycle of this petitioner.

Considering the the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
