The petitioner seeks bail in connection with Gopalpur P.S. Case No. 111 of 2021, dated 11.06.2021, instituted for the offences under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code and Sections 30(a), 32(2) and 41(i) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Though huge quantity of recovery is said to have been recovered from a truck but the prosecution of the

Patna High Court CR. MISC. No.55592 of 2021(2) dt.23-05-2022 2/2 petitioner is on the basis of the statement made by the driver of the said truck that the petitioner had loaded the consignment of liquor on the said truck.

The petitioner is in custody since 19.06.2021. Though the petitioner has earlier been made accused in a case of similar nature but in the aforesaid case, he has been granted bail.

Considering the period of custody of the petitioner which he has undergone up-till now, he is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. District & Sessions Judge-II, Gopalganj, Bihar in connection with Gopalpur P.S. Case No. 111 of 2021.

The application stands allowed.
