Mr.Mukesh Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 16-07-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

Petitioner apprehends his arrest in connection with Khajekala P.S. Case No.217 of 2018 for the offence punishable under Section 363, 365 of the Indian Penal Code. The allegation against the petitioner is that as per the First Information Report, the daughter of the informant has been abducted by the petitioner and was taken to some other place on motorcycle.

Learned counsel for the petitioner submits that there was love affairs between the petitioner as well as the daughter of the informant. Victim girl was recovered and in her statement under Section 164 Cr.P.C., she has stated that she was called by the petitioner near the Patna Junction and from where they went to Harnut and stayed about two days in a hotel. She further stated that petitioner

Learned counsel for the petitioner further submits that doctor upon examination of the victim has opined the age of the victim girl between 17 to 19 years. Accordingly, he submits that the girl is at least 18 years old and is major.

After having heard learned counsel for the petitioner as well as learned counsel appearing on behalf of the State and taking into consideration the fact that there appears to be love affairs between petitioner and the victim girl and the doctor has assessed the age of the girl between 17 to 19 years, as such, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner is directed to surrender before the learned Court below within a period of four weeks and in the event of surrender by the petitioner, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City, subject to the condition as mentioned under Section 438 (2) of Cr.P.C.
