Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 22.11.2018 passed in Cr. Misc. No.61779 of 2018 and secondly, vide order dated 4.4.2019 passed in Cr. Misc. No.20977 of 2019. Allegation against the petitioner is that he thrashed the deceased on ground and other accused persons stabbed him. Submission of the learned counsel for the petitioner is that during the trial all the materials witnesses have been examined and nothing has been attributed against the petitioner, which will appear from the impugned order. Petitioner is in custody since 22.5.2018.

Heard learned A.P.P. and from perusal fo the

Patna High Court CR. MISC. No.43489 of 2019(2) dt.17-07-2019 2/2 impugned order, it appears that the learned trial court has observed in the impugned order that the charge sheeted witnesses have already been examined in this case and the I.O. of the case ..

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Motihari, East Champaran in connection with Sessions Trial No.346 of 2018 arising out of Motihari Town P.S.Case No.518 of 2017 G.R.Case No.4703 of 2017, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid direction, this application is allowed.
