Petitioners are in custody in connection with Excise Case No. 427 of 2019 for the offence under section 30(a) of Bihar Prohibition and Excise Act, 2016 Learned counsel for the petitioner would submit that petitioners have no criminal antecedent.
Learned counsel for the petitioner submits that in the instant case total 128.4 liters of nepali wine was recovered from the possession of the petitioners.
Learned counsel submits that petitioners are in
Patna High Court CR. MISC. No.49221 of 2019(2) dt.07-08-2019 2/2 custody since 15.5.2019.
Considering the fact that petitioners have no criminal antecedent, the Court is inclined to grant bail to the petitioners, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Motihari, East Champaran, in connection with Excise Case No. 427 of 2019.
