The petitioner apprehends his arrest in a case under Sections 302 and 34 of the Indian Penal Code. The informant (brother of the deceased) named six persons and alleged that they all assaulted his brother Yogendra Sharma and killed him. It is submitted that the informant is not an eye witness of the occurrence. Similarly situated co-accused Rajeshwar Yadav, Mithilesh Yadav and Baran Yadav have already been enlarged on regular bail. One of the accused, namely, Dharmendra Manjhi has been granted anticipatory bail vide order passed in Cr. Misc. No. 17590/2015. The case of the petitioner stands on the same footing as that of Dharmendra Manjhi. Learned A.P.P. did not dispute the above facts.
