JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 Petitioner seeks bail in connection with Special Case No. 29A of 2018, arising out of Chakand P.S. Case No. 53 of 2018, for the offences under Sections 217, 221, 222, 120B of IPC.

Earlier prayer for bail of the petitioner was rejected by this Court, vide order dated 17.12.2018, passed in Criminal Misc. No. 68030 of 2018.

Petitioner happens to be the Sub Inspector of Bihar Police and allegation against him is that he released two accused persons with liquor recovered from after taking bribe and further Rs. 1,37,200/- was recovered from his room. Submission of learned counsel for the petitioner is that he is in custody for more than a year and up till now the charge has been framed.

Having heard both sides and perused the record, from which, it appears that petitioner has filed a petition for discharge, which has been disposed of by this Court on 20.08.2019 and now the case is pending for framing of charge, I am not inclined to grant privilege of bail to the petitioner. Let learned Trial Court, Patna is directed to frame the charge against the petitioner and proceed with the trial and tried to conclude the trial as soon as possible.
