The petitioners apprehend their arrest in connection with Tr. No. 476/2019/827/2018 arising out of Forest Case No. 09 of 2011 registered under Sections 33, 41 and 42 of the Indian Penal Code and Sections 17, 27 and 29 of the Wild Life Protection Act.

The accusation that, on receiving information about keeping logs of Sakhua wood in bush after cutting from the reserve forest, the Forest Officials reached there and saw four persons there and on seeing the Forest Officials three persons succeeded to flee away, while one was apprehended, who

Patna High Court CR. MISC. No.46281 of 2019(2) dt.26-07-2019 2/2 disclosed his name as Ramayan Ram. On query, Ramayan Ram disclosed the name of three persons including the petitioners, who succeeded to flee away. On search, four pieces of Sakhua wood were recovered.

Learned counsel for the petitioners submits that petitioners were not apprehended at the spot but their names have come in the confessional statement of co-accused, Ramayan Ram and petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Bettiah, West Champaran, in connection with Tr. No. 476/2019/827/2018 arising out of Forest Case No. 09 of 2011, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
