This is a petition for grant of anticipatory bail for offence under Section 409 of the Indian Penal Code. The petitioner was Sub Post Master of Mohiuddin Nagar Post Office. He telephonically reported to his superior officer, i.e., the informant of this case, that some miscreants has snatched his key and has tied him with ropes. When the informant came, he found that theft has been committed in the Sub Post Office. However, suspected involvement of the petitioner also as the petitioner did not show the correct place of occurrence from where the key was snatched. After investigation the police did not sent-up the petitioner for trial. However,

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Mohiuddin Nagar P.S. Case No. 27 of 2015 to the satisfaction of the Chief Judicial Magistrate, Samastipur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
