The petitioner has filed the instant application for grant of regular bail in connection with Sikta P.S. Case no. 81 of 2020 registered under section 379 of the Indian Penal Code. As per allegation in the F.I.R., the motorcycle of the informant was stolen which was later found in the possession of the petitioner.

It is submitted by learned counsel for the petitioner that allegation of recovery of the stolen motorcycle from possession of the petitioner is incorrect. The petitioner runs a garage and a motorcycle had been brought there by one Manish Kumar. The petitioner has no criminal antecedent and is in custody since 09.09.2020. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the fact of the petitioner being in custody since 09.09.2020 and having no criminal antecedent, this Court is inclined to enlarge the petitioner on regular bail. The above named petitioner is directed to be enlarged on bail in connection with Sikta P.S. Case no. 81 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Bettiah, West Champaran.
