2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in a case instituted for the offence punishable under Sections 191(2), 190, 329(3), 329(4), 126(2),
2/4 115(2), 75, 324(2), 303(2), 352, 351(2), 351(3) of Bharatiya Nyaya Sanhita.

The prosecution case, in brief, is that the petitioner, along with the other co-accused persons, allegedly arrived at the residence and courtyard of the informant while being variously armed and enquired about her son, Sachin Kumar Singh, alleging that he had eloped with their niece. Upon the informant expressing ignorance, the accused persons allegedly caught hold of her and pushed her to the ground. It is further alleged that they damaged her motorcycle, tempo and house, and looted a box containing Rs. 10,000/- in cash and ornaments.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in the present case due to village politics. There is case and counter case between the parties. A statement has been made in para 3 of the petition that
3/4 petitioners have clean antecedent. Moreover, similarly situated several co-accused persons have already been granted bail vide order dated 19.05.2026, passed in Cr. Misc. No. 33543 of 2026 by co-ordinate Bench of this Court.
5. Learned A.P.P. for the State has vehemently opposed the prayer of bail.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from the date of receipt/production of this order and in the event of their arrest or surrender in connection with Mahishi P.S. Case no. 42 of 2026, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, subject to the conditions as laid
4/4 down under section 482 of Bharatiya Nagrik Suraksha Sanhita (BNSS).
