JUSTICE ARUN KUMAR ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Section 7 of the E.C. Act. Allegation in brief is that the Block Supply Officer raided the go down of the rice mill of the petitioner and found 259 bags of rice of S.F.C. and 50 quintals of rice spread on the floor of the mill.
Submission is that petitioner is Rice Miller and he has an agreement with the PACS for milling the paddy and supply the rice only; because the rice was found kept in S.F.C. bags purchased from the market so this case was lodged and against the petitioner not any case was lodged under Section 7 of the E.C. Act except present one.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of
Patna High Court Cr.Misc. No.30340 of 2017 (2) dt.10-07-2017 2/2 receipt of this order to the concerned court, let the petitioner, namely, Ranjeet Singh @ Ranjeet Kumar Singh be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Bhojpur, Ara in connection with Charpokhari P.S. Case No.106 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
