The petitioner apprehends her arrest in Islampur P.S. Case No.644 of 2020, registered for the offences punishable under Sections 341, 323, 504, 326, 307 and 34 of the Indian Penal Code.

The petitioner and her husband are said to have assaulted the husband of the informant by means of spade on his back and right leg causing cut and fracture injuries. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. There is general and omnibus allegation against the petitioner. The specific allegation is against co-accused, Santosh Chauhan. It is further submitted that the petitioner is

Patna High Court CR. MISC. No.55060 of 2021(3) dt.28-07-2022 2/2 wife of Santosh Chauhan and she has got no criminal antecedent.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

From perusal of the injury report, it transpires that the injuries are grievous in nature.

Taking into consideration the fact that the injuries are grievous in nature, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
