The petitioners seek bail in a case registered under Sections 147, 148, 149, 323, 324, 341, 307, 302 and 427 of the Indian Penal Code.

The prosecution case, in brief, is that while the nephew of the informant arrived near Idgah, the accused persons encircled him and assaulted with Belt, Danda etc. It is also alleged that one of the accused inflicted 3-4 knife blows in the left side of stomach of informant's nephew, as a result of which, he sustained grievous injury and in course of treatment, he died. It has been submitted on behalf of the petitioners that the

Patna High Court CR. MISC. No.43764 of 2019(2) dt.16-07-2019 2/2 petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 27.04.2019. Specific allegation of assault is alleged against the co-accused Hari Shankar Mahto. So far rest of the accused persons are concerned, general and omnibus allegation has been made against them. No specific injury is attributed to the petitioners. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj P.S. Case No. 206 of 2019.
