2. The petitioners apprehend arrest in connection with Gopalpur P.S. Case No. 270 of 2024, registered under Sections 126(2), 115(2), 118(1), 109(1), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that, the informant was attacked at his poultry farm by co-accused persons, including the petitioners for refusing to give them a chicken. It is further alleged that the accused persons damaged the farm.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Learned counsel for the petitioners also submits that the allegation levelled against the petitioners is general and

Patna High Court CR. MISC. No.45642 of 2025(2) dt.11-07-2025 2/2 omnibus in nature. Though, it is alleged that the informant was assaulted by spade, but injury is found to be simple in nature. There is no allegation of repetition of blow given on the informant. Petitioner no. 1 has got one criminal antecedent and petitioner no. 2 has got no criminal antecedent. Learned counsel for the petitioners further submits that similarly situated coaccused has been granted regular bail by this Court vide order dated 24.02.2025 passed in Cr. Misc. No. 9756 of 2025.

5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioners.

Considering the aforesaid facts and circumstances, let the petitioners, above named in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Gopalpur P.S. Case No. 270 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
