The petitioner seeks bail in anticipation of his arrest in connection with Muffasil P.S. Case No. 662 of 2018 instituted for the offences under Sections 341, 342, 323, 307, 504 and 34 of the Indian Penal Code.
It has been alleged in the First Information Report that the petitioner had concealed liquor beneath the land belonging to the informant.
It has been submitted on behalf of the petitioner that the accusation is absolutely absurd. Nothing has been recovered from the possession of the petitioner. In fact, the
Patna High Court CR. MISC. No.1156 of 2021(2) dt.11-08-2021 2/2 informant only is responsible for the recovery of liquor from beneath his land. Nothing has been collected during the course of investigation to connect the petitioner with the offence. It appears that the petitioner has been made accused in this case because of the machinations of local police after getting into collusion with the informant. Regard being had to the afore-stated facts and taking into account the clean antecedents of the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge (Excise Act), Begusarai, in connection with Muffasil P.S. Case No. 662 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
