JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The prosecution case is that mother of the informant made protest for destroying the Kharahi at the hands of the accused when accused persons assaulted the mother of the informant by fists and slaps who subsequently succumbed to the injuries.
It is submitted by learned counsel for the petitioners that accusation of assault with fists and slaps is against six persons but the postmortem reflects no external or internal injury. The victim was more than eighty years of age and she died natural death. The postmortem reflects that cause of death has not been ascertained and viscera has been preserved.
Considering the fact that accusation is not

No.53235 of 2015 (2) dt.23-11-2015 2/2 being corroborated with the medical opinion and the petitioners being ladies having no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Barauli P.S. Case No. 90 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
