JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2019 Nobody appears on behalf of the petitioner in spite of repeated calls. It appears that on last date also i.e. on 07.05.2019, none has appeared on behalf of the petitioner. This application has been filed for transfer of Complaint Case No. 1611 of 2016 from the Court of learned SDJM Bhagalpur, to the Court of learned SDJM Khagaria. Ground taken by the petitioner for transfer of the aforesaid case is that petitioner is an old lady and suffering from multiple disease and she is not able to attend the court at Bhagalpur. Petitioner happens to be mother in law of the opposite party no. 2 and there is allegation of demand of dowry and for torturing and harassing the opposite party no. 2. The

No.46239 of 2018(4) dt.18-06-2019 2/2 petitioner in support of her contention that she is suffering from several disease, she has annexed the prescription of a Doctor, as Annexure - 2 to the petition, which disclosed that the petitioner is suffering from the blood pressure disease and she has stated her age to be 54 years, on oath and as such, it does not appear that she is such an old lady, who cannot attend the Court at Bhagalpur.

Accordingly, I do not find any merit in the instant transfer petitioner and the same is, accordingly, dismissed. (Vinod Kumar Sinha, J) sunilkumar/- U T
