2. The present application, for grant of anticipatory

Patna High Court CR. MISC. No.45288 of 2025(2) dt.30-07-2025 2/3 bail, arises out of Madanpur Police Station Case No. 182 of 2025 registered on 06.05.2025 for the offences under Sections 119(2), 126(2), 115(2), 118(2), 109, 303(2), 352 of the BNS.

3. As per the First Information Report, on 04.05.2025, while the informant had gone to the house of one Manoj Singh to attend marriage ceremony, his brother, Sonu Kumar Singh was at the home. The petitioners along with other accused persons armed with Lathi, Danda and sharp edged weapons arrived at the house of the informant and assaulted his brother, Sonu Kumar Singh.

4. Learned counsel for the petitioners submits that both the parties are co-villagers, there is a land dispute between the parties. A counter case has been lodged by the side of the petitioners bearing Madanpur PS Case No. 184/2025 alleging therein that side of the informant forcefully started construction over the ancestral land of the petitioners. The allegation against the petitioners is general and omnibus in nature. Referring to the order impugned, learned counsel submits that though the brother of the informant has received seven injuries on his persons but the nature of injury has not been mentioned as grievous.

5. Learned APP opposes the prayer for anticipatory bail of the petitioners vehemently.

Having regard to the submissions made by the parties and taking into consideration the nature of the allegation and the fact that both the parties are co-villagers having case and counter case against one another and the injury sustained by the informant's brother has not been described as grievous in the order impugned, I am inclined to grant all the aforementioned petitioners the privilege of anticipatory bail.

6. Let the petitioners, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with the aforesaid Police Station Case subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
