2. Petitioner apprehends arrest in Guthni P.S. Case No. 360 of 2025 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, total 113.730 litres illicit liquor was recovered from the seized car bearing Reg. No. BR01AS0278 of which this petitioner is registered owner.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. Petitioner has been made accused in this case merely because he is owner of the seized car and he has got no concern with the alleged recovery.

5. Learned A.P.P. for the State opposed the bail

Patna High Court CR. MISC. No.46074 of 2026(2) dt.14-07-2026 2/2 application and submits that petitioner is owner of the seized vehicle and has got one criminal antecedent.

6. Considering the fact that petitioner is owner of the seized vehicle and has got one criminal antecedent, anticipatory bail of the petitioner is rejected.
