The petitioners, who are own brothers, seek bail in connection with Barun P.S. Case No. 93 of 2020 dated 07.06.2020 instituted for the offences under Sections 147, 149, 341, 323, 324, 354, 448, 307, 504, 506 of the Indian Penal Code.

A fight is alleged to have taken place between the two parties because of an attempt of the petitioner no.1 to outrage the modesty of the niece of the Informant.

It has been alleged on behalf of the petitioners that because of the other side trying to obstruct the supply of electricity, a protest was made which led to altercation between the two families.

The counter case appears to have been lodged earlier vide Barun P.S. Case No. 90 of 2020.

In the occurrence reported in the subject F.I.R., nine persons have been injured from the side of the prosecution but, seven persons have been injured form the side of the petitioners also including the opposite party no.2. The parents of the petitioners have also received grievous injuries.

It has further been submitted that the accused persons of the counter case have all been granted bail. The petitioners are in custody since 17.05.2022. Regard being had to the nature of accusation and counter accusation, the petitioners being the neighbors of the Informant and the period of custody, the petitioners are directed to be released on bail on his furnishing bail bonds in
