JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504, 506/34 of the Indian Penal Code.
The prosecution case is that the accused persons including the petitioner were plucking the mango from the orchard of the informant when informant made protest co-accused Raghbir Sah assaulted with iron rod causing head injury. It is further alleged that accused persons snatched gold chain from the informant's maternal aunt and took away Rs.5000/- from the informant.
It is submitted by learned counsel for the petitioner that petitioner is agnate of the informant and in the background of petty dispute the accusation has been levelled. Moreover, the
Patna High Court Cr.Misc. No.53112 of 2015 (2) dt.23-11-2015 2/2 specific accusation of making assault is against Raghubir Sah. Though injury has been found to be simple in nature. There is counter version of the occurrence also.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Barhariya P.S. Case No.150 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
