The petitioner seeks bail in Baniyapur P.S. Case No. 116 of 2019, instituted for the offence under Section(s) 414, 420, 467, 468, 470 and 471 of Indian Penal Code. Counsel for the petitioner submits that petitioner is in custody since 24.4.2019.

It is alleged in the written report that Police got information that one Bolero vehicle is standing by the south side of Block Development Office, Baniyapur, which was expected to be stolen one. The police brought the vehicle to the Police Station. The owner of the vehicle (petitioner) produced the document on 26.3.2019 in support of ownership of the vehicle. It is further alleged that when the document was verified, it was

Counsel for the petitioner submits that petitioner has purchased the aforesaid vehicle from Surendra Sah. The sale letter dated 21.1.2012 was executed by Pramod Kumar Ojha stating that he has sold the vehicle to Bhawan Miyan. Counsel for the petitioner further submits that he has purchased the vehicle from bona fide purchaser Surendra Sah. Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Saran, in connection with Baniyapur P.S. Case No. 116 of 2019,, subject to the condition that both the bailors will be close relatives of the petitioner.
