The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471, 120B, 506 of the Indian Penal Code.
The prosecution case is that petitioner and others purchased the land and house of the informant from Bachho Singh and made attempt to dispossess. It is submitted by the learned counsel for the petitioner that the alleged land is recorded jointly in the name of Baijnath Singh and Ashideo Singh. The vendor of the petitioner is the son of Bachho Singh, S/o Bodha Singh. Though, it is claimed by the informant that Bodha Singh was issueless, but the case of the petitioner's side is that the
Patna High Court Cr.Misc. No.54091 of 2015 (2) dt.30-11-2015 Bachho Singh is son of Bodha Singh and Title Suit is pending for the same cause of action.
Considering the nature of accusation and Title Suit is pending between the parties, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 187 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
