Md. Nazir Ansari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-07-2021 Heard Mr. Uday Chand Prasad, the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Kumarkhand P.S. Case No. 159 of 2020, instituted for the offences under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.

Patna High Court CR. MISC. No.1314 of 2021(2) dt.08-07-2021 2/3 The petitioner is said to have assaulted the informant on his head by means of an iron rod. The other persons are also said to have assaulted the other members of the prosecution party.

It has been submitted on behalf of the petitioner that though he has been named in the F.I.R. with specific accusation of assaulting the informant but the injuries suffered by him is stated to be simple in nature. The other injured person of this case also has received simple injury. It has further been submitted that the petitioner has been made accused in this case because of an old land dispute. Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No. 159 of 2020, subject to the conditions laid down under

Patna High Court CR. MISC. No.1314 of 2021(2) dt.08-07-2021 3/3 Section 438(2) of the Cr.P.C.

The application stands allowed.
