The petitioners apprehend their arrest in Dumariyaghat P.S. Case No. 203 of 2020, registered for the offences punishable under Sections 302, 120B, 201 of the Indian Penal Code and section 27 of the Arms Act.

As per the FIR, on 23.10.2021 at about 7.30 pm informant's son had gone to see Mela and stayed that night at the house of his Samadhi namely, Rama Sahani. On the next i.e. on 24.10.2020 at about 7.00 am he came to know that deadbody of his son was lying in a pool. On such information the

Patna High Court CR. MISC. No.55684 of 2021(2) dt.28-06-2022 2/2 informant along with villagers reached at the place of occurrence and saw the dead-body of his son. The informant suspected that all the accused persons including petitioner committed murder of his son.

It is submitted that petitioners are relatives of informant. The son of informant (deceased) was in association of anti-social elements and they might have killed his son for which petitioners could not be held guilty. Further submitted that one of co-accused namely, Ranjeet Sahani has been granted regular bail by this Court vide order dated 29.11.2021. petitioners have got clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Motihari, East Champaran in connection with Dumariyaghat P.S. Case No. 203 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
