In this case, the petitioner is apprehending his arrest in connection with Aurangabad Town P.S. Case No. 65 of 2017 registered for offences under sections 468, 471, 420, 409, 120(B) of the Indian Penal Code.
As per allegation, one Chandeshwar Choudhary and Ranjit Kumar, the present petitioner, both clerks in the office of the Civil Surgeon Office, created a forged document and, on that basis, certain persons joined the service. When it came to the knowledge, persons appointed were removed from their services. Learned counsel for the petitioner has submitted that actually those persons were terminated on the ground of forged
Patna High Court Cr.Misc. No.24144 of 2017 (3) dt.25-08-2017 document, have been reinstated in service in compliance of the order passed by this Court and, since then, they are performing their duty and received salary. Again their services were terminated as per order passed in L.P.A. but, the Hon'ble Apex Court stayed the operation of the order passed by L.P.A. Court, thereafter, they joined the post.
Looking to the entire facts and circumstances of the case, let the petitioner, namely, Ranjit Kumar, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 65 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been cancelled.
