JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-08-2017 The petitioner is apprehending his arrest in connection with Dhanarua P.S. Case No. 140 of 2017, registered for offences punishable under Sections 341, 323, 376, 504 of Indian Penal Code and Section 4 of POCSO Act.

Allegation against the petitioner is of committing rape on the informant.

It has been submitted on behalf of the petitioner that out and out false and fabricated case has been lodged against the petitioner as there was love affair between the parties and only they were caught, the informant in fear of her guardian has lodged this present false case. Further the girl is not minor as alleged. Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and circumstances of the case, nature of offence, I am not inclined to

Patna High Court Cr.Misc. No.36575 of 2017 (2) dt.11-08-2017 grant the petitioner, the privilege of anticipatory bail, his application is accordingly, rejected.

Let petitioner surrender before the Court below and make prayer for regular bail and if any such application is filed, the same will be considered by the court below on the basis of materials available on record.
