JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-07-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioners apprehend their arrest in connection with Isuapur P.S. Case No.173 of 2018 registered under Sections 147, 341, 323, 324, 307 and 504 of the Indian Penal Code. The accusation is that 9 persons, named in the F.I.R., including the petitioners having lathi, danda, rod and other deadly weapons came at the house of the informant. Thereafter, Vishwanath Rai started to cause assault to Brahamdeo Rai, the father of the informant, through lathi. In the meantime, Mahesh Rai caused injury at the head of the father of the informant through rod, whereas Vikash Kumar caused injury at the head of Lalbabu Rai, the uncle of the informant, through rod. When Sudhanshu Ranjan, another cousin of the informant, rushed to pacify the matter, Raghuvansh Kumar caused injury at his right hand through Bhala. At that time, Ramjit Rai caused injury through bricks at the chick and head of Pankaj Kumar, the brother of the informant.
Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. but no specific overt act is attributed to them. The petitioners have no criminal antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Chapra at Saran, in connection with Isuapur P.S. Case No.173 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
