Earlier the bail application of petitioner was rejected vide order dated 02.11.2020. It is submitted that subsequently co-accused Sintu Kumar who is alleged to have fired at the chest of deceased Ankush has been granted bail by a coordinate Bench of this court vide order dated 06.01.2022. It is further submitted that three witnesses who claimed to be eye-witnesses but none of them identified or named this petitioner as one of the accused. Petitioner is in custody since 22.12.2019 having clean antecedent.

Considering the fact that similarly situated co-accused Sintu Kumar has already been granted bail by this Court, the petitioner above-named, is directed to be enlarged on bail on

Patna High Court CR. MISC. No.56324 of 2021(3) dt.02-02-2022 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sesssions Judge VIth, Madhepura in connection with Gawalpara P.S. Case No. 226 of 2019 corresponding to Sessions Trial No. 59 of 2020.
