JUSTICE SANDEEP KUMAR ORAL ORDER 09-08-2023 This is an application for grant of Anticipatory Bail to the petitioners who apprehends their arrest in connection with Motihari Muffasil P.S. Case No. 25 of 2021 registered for the offences under Sections 302/34 of the IPC and Section 27 of the Arms Act.

2. Heard the parties.

3. Learned counsel for the petitioner seeks permission to withdraw the application on behalf of the petitioner no. 1.

4. Permission is accorded.

5. Accordingly, this application is dismissed as withdrawn on behalf of petitioner no. 1.

6. The only ground for renewal of the anticipatory bail of the petitioner no. 2 is that one person has been granted anticipatory bail after disposal of the present case.

7. This is no ground for renewal of prayer of anticipatory bail.

8. The petitioner is directed to surrender within four weeks from today failing which the Superintendent of Police, East Champaran will take all steps for arrest of the petitioner no. 2.

9. Accordingly, this application is dismissed.

10. Let a copy of this order be communicated to the Senior Superintendent of Police, East Champaran through FAX for its compliance forthwith.
