JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 05-08-2025 Heard Mr. Sarvesh Kashyap, learned counsel for the petitioners and Mr. Lalan Kumar, learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Bairiya P.S. Case No. 173 of 2025 instituted for the offence under Sections 191(2), 191(3), 126(2), 115(2), 118(1), 117(2), 109, 324(4) and 352 of B.N.S.

3. The case of the prosecution is that the petitioners

Patna High Court CR. MISC. No.46075 of 2025(2) dt.05-08-2025 2/3 assaulted the family members of the informant.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have falsely been implicated in this case. It has further been submitted that the injury report which has been annexed with the petition will go to show that all the injured persons have received simple injury. It has also been submitted that there is also a counter version of this case. It has also been submitted that petitioner no.4 has also received injuries during the occurrence. Both are agnates and both parties have received injuries.

5. Learned APP appearing for the State has conceded to the arguments of the learned counsel for the petitioners that injured persons of this case have received simple injuries and there is counter version of this case as well.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Bairiya P.S. Case No. 173 of 2025, they will be enlarged on bail on furnishing bail bond of
