====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 27-10-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sasaram Town P.S. Case No. 244 of 2020 for the offence punishable under Sections 414 of the Indian Penal Code. According to the prosecution, one looted Pulsar Motorcycle has been recovered from the cattle shed situated in front of the house of the petitioner.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing incriminating has been recovered from the conscious possession of the petitioner and he has falsely been

Patna High Court CR. MISC. No.107 of 2021(3) dt.27-10-2021 2/2 implicated in this case merely on the basis of suspicion. Hence, the petitioner may be granted the privilege of anticipatory bail.

Learned A.P.P. for the State submits that the petitioner is named in the F.I.R. and one Pulsar Motorcycle bearing Engine No. DHZWEA-37579 has been recovered from the cattle shed situated at west corner of the house of the petitioner.

Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, the prayer for grant of anticipatory bail of this petitioner is rejected. (Rajesh Kumar Verma, J) braj/- U T
