1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioner apprehends their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109(1), 352, 351(2) and 3(5) of the BNS, 2023 and 27 of the Arms Act.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that on 20.11.2025 at 02:00 AM he heard some noise, thus came out of the house and saw that on the disputed land construction work was going on, thus he informed his family members, accordingly his family members objected, when Sonu

No.44314 of 2026(2) dt.20-07-2026 2/3 assaulted him by rod causing injury on head thereafter, Vikram by rod assaulted Amrendra causing fracture of left hand, thereafter Sonu also assaulted him all over his body by rod, while Vishwavijay fired at Raushan but missed, thereafter assaulted him by butt of pistol causing injury on elbow, further Aman also fired, next alleges that Kanhaiya, Jitendra and petitioner assaulted Manish by lathi.

Learned counsel appearing on behalf of the petitioners submits petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to land, it is next from perusal of the allegation as alleged in the FIR, it would manifest that informant alleges that petitioners along with Jitendra assaulted Manish by lathi, but then allegation of assault is not specific and from perusal of the injury report annexed as Annexure-2 to the anticipatory bail application, it would manifest that the injury suffered by Manish has been opined to simple in nature, it is next submitted that petitioners are not criminals and allegation of firing and assault is against specific named accused persons.
5. Learned A.P.P. for the State opposes the anticipatory bail application of the petitioners.
6. Considering the submissions made by learned counsel
Patna High Court CR. MISC. No.44314 of 2026(2) dt.20-07-2026 3/3 for the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mohiuddinnagar P.S. Case No. 243 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. The application stands allowed.
