The petitioner is languishing in custody for the offences punishable under Sections 341/342/324 /307 /302 / 427/34 of the Indian Penal Code.
The informant and deceased Aman Kumar were going on a motorcycle, near Marra Chowk two persons were talking on the road which caused inconvenience in smooth trafficking. When the informant asked them to be at the side, one of the two boys, namely, Randhir Kumar, started assault on the informant. On that Aman Kumar fired from his pistol. In the meantime, 15-20 villagers came there and bitterly assaulted to Aman as a result whereof Aman died. The petitioner and
Patna High Court CR. MISC. No.44196 of 2019(2) dt.18-07-2019 2/2 others were identified among the villagers.
Submission is that allegation is general and omnibus. The petitioner has got no criminal antecedent. He is in custody since 10.05.2019.
Considering the facts aforesaid, let the petitioner, above named, be released on bail after completion of investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Muffasil P.S. Case No.232 of 2019, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
