JUSTICE SHIVAJI PANDEY ORAL ORDER 25-08-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking anticipatory bail in connection with Naugachhia P.S. Case No.87 of 2015, registered for the offence punishable under Sections 365, 323, 379, 504 and 506/34 of the Indian Penal Code. Allegation has been made that the victim, who is posted in the Indian Army, was picked up by the petitioner and other 3 to 4 persons and forced to enter into the marriage. As per the F.I.R. it was a kidnapping, but the case diary shows that it was a marriage. It has been submitted the victim was intended to marry, later on, there was demand of dowry, when it was not fulfilled, the present case has been lodged.

No.23868 of 2017 (3) dt.25-08-2017 2/2 Looking to the aforesaid facts, let the petitionerPrem Chaudhary @ Prem Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1st, Naugachhia, in connection with Naugachhia P.S. Case No.87 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
