The learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within
Patna High Court CR. MISC. No.46230 of 2022(2) dt.08-12-2022 2/3 one month.
Heard learned counsel for the petitioners and the learned APPs for the State.
Petitioners seek regular bail in connection with Patliputra P.S. Case No.275 of 2022 registered for the offences punishable under Sections 356, 379, 341, 323, 324, 308 and 34 of the Indian Penal Code.
As per the prosecution, the informant and his elder brother were assaulted by some unknown persons by means of lathi, danda, iron rod, cricket-bat and fire arms. Later, on complaint of the informant these petitioners along with one coaccused were apprehended by the police. The main submissions advanced by the learned counsel Mr. Awadhesh Kumar Singh appearing for the petitioners are that in the present matter informant and his brother are stated to be the injured persons and during the course of investigation the informant did not get himself examined medically and the injuries of the informant's brother were opined to be simple in nature and both the petitioners have clean antecedent and they have been languishing in jail since 20.05.2022 and petitioner Sonu Kumar @ Bipin Kumar is a different person from the named accused Sonu Kumar
Patna High Court CR. MISC. No.46230 of 2022(2) dt.08-12-2022 3/3 mentioned in the FIR and in this regard a statement has been made in paragraph No.11 of the petition of petitioner Sonu Kumar @ Bipin Kumar and both the petitioners belong to two different families.
Learned APP Mr. Dilip Kumar No. 1 appearing for the State has opposed the bail prayer.
Having considered the above submissions and mainly taking into account the clean antecedent of the petitioners and their custody period, in the opinion of this Court a lenient approach can be taken in respect of the petitioners' prayer, let the petitioners be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Patliputra P.S. Case No.275 of 2022 .
