The petitioner apprehends his arrest in Complaint Case No.2316C of 2017 for the offences allegedly committed by the petitioner under Sections 498A and 323 of the Indian Penal Code.

The complainant (wife of petitioner) of course made allegation of demand of dowry and torture but it appears that the complainant was married with the petitioner in the year 2002 and she remained in her sasural. The complainant filed complaint case only after fifteen years of her marriage alleging that her husband subjected her to all sorts of torture due to nonfulfillment of additional demand of dowry.

No.43532 of 2019(2) dt.16-07-2019 2/2 Having considered the facts and the nature of allegation made against the petitioner and the fact that the complainant filed the complaint case after fifteen years of her marriage with the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Complaint Case No.2316C of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
