2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in a case instituted for the offence punishable under Sections 347, 149, 341, 342, 323, 354, 498(A), 504, 506 of the Indian Penal Code.

3. As per the allegation, complainant was married to petitioner in the year 2008. Allegation against the petitioner and other co-accused persons is that they used to assault, torture and outraged the modesty of the informant.

4. In pursuance to the direction of this Court, both parties appeared with the respective counsel.

5. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. As per his submission, informant is a quarrelsome lady who do not want to stay at her matrimonial house. Earlier, he has also filed several cases against the petitioner.

6. It is submitted by the petitioner himself, before the Court, that he is ready to maintain his wife and for this he is ready to pay Rs. 4,000/- (four thousand rupees) per month as interim maintenance to the informant.

7. The learned counsel appearing on behalf of the informant has accepted the offer of the petitioner and undertakes to provide bank account details of the informant to the petitioner as early as possible.

8. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated

3/4 above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Shivsagar P.S. Case No. 522 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, subject to the conditions as laid down under section 438(2) of the Cr.P.C.

9. The petitioner is directed to make payment of Rs. 4,000/- ( four thousand rupees) per month to the informant by depositing the same in her bank account commencing from the month of March, 2025.

10. The bail bonds of the petitioner shall be accepted by the learned court below on showing receipt of deposit of two installments Rs. 4,000/- each (ie. Rs. 8,000/-) by the petitioner in the account of the informant.
