Petitioner is in custody in connection with Case No. 22C2 of 2019 for the offence under section 30(a), of the Bihar Prohibition and Excise (Amendment) Act, 2018. It is alleged that total 22 liters of country made wine was seized from the possession of the petitioner. Learned counsel for the petitioner submits that mandatory provision of section 100 Cr.P.C. was not followed in preparation of seizure list.

Learned counsel submits that petitioner has no criminal antecedent and he is in custody since 19.6.2019. Considering the fact that petitioner has no criminal
