2. The petitioner has preferred this application for grant of regular bail in connection with Kako P.S. Case No. 87 of 2025, dated 02.04.2025 registered for the offences punishable under Sections 191(2), 190, 103(1) and 303 of the BNS and under Section 27 of the Arms Act.
3. As per the prosecution case, on 01.04.2025 at about 11:00 PM, the co-accused persons including the petitioner, armed with fire-arms, entered the house of informant through cowshed and started firing indiscriminately. Thereafter, they entered the rooms and started looting. They broke Godrej almirah and took Rs. 5 lakh along with 11 bhar gold ornaments

No.44943 of 2025(2) dt.30-07-2025 2/3 and when informant's family members opposed the same, Sudhir, Nitish and Gajendra fired on the daughter of informant as a result, two bullets hit her right arm and one bullet hit her right chest. Thereafter, Jitendra fired on her daughter-in-law with an intention to kill and the bullet hit her right hand. After looting money and gold ornaments the co-accused persons fled away. It is further alleged that the daughter of informant succumbed to her injury.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to admitted land dispute. There is no specific allegation of any assault or overt act attributed against the petitioner, rather the specific allegation of firing is attributed against the co-accused persons namely, Sudhir, Nitish, Gajendra and Jitendra and at best the petitioner may be considered as member of the group. The name of petitioner has been dragged in the present case due to the fact that he is brother of the coaccused Sudhir. The petitioner has got one criminal antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 02.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jehanabad, in connection with Kako P.S. Case No. 87 of 2025.
7. The application stands allowed.
