JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Apprehending his arrest in connection with Town P.S.Case No.602 of 2016 registered for the offences under Sections 272 and 273 of the Indian Penal Code and Section 47 of the Bihar Excise (Amendment) Act, 2016 the petitioner has filed the present application under Section 438 of the Code of Criminal Procedure for grant of pre-arrest bail.

Regarding being had to the recovery of huge quantity of illicit liquor from a vehicle being driven by the petitioner, I am not inclined to grant pre-arrest bail to the petitioner.

Patna High Court Cr.Misc. No.29860 of 2017 (2) dt.13-07-2017 2/2 Accordingly, the prayer for grant of anticipatory bail is rejected.

In case the petitioner surrenders and seeks bail, the same shall be considered on its own merits without being prejudiced in any manner by this order.
