JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 342, 323, 341, 325, 326, 337, 338, 307, 333, 353, 427, 504, 506, 153A, 295A of the Indian Penal Code and 27 of the Arms Act. It is alleged that on the eve Moharram festival the petitioner was leading the mob which pelted stones on the police personnel and others causing injuries to the SDO and SDPO. It is submitted by learned counsel for the petitioner that the accusation is against the mob. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that co-accused have been granted anticipatory bail vide Criminal Miscellaneous No.40693 of 2014.

No.54215 of 2015 (2) dt.30-11-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sheohar in connection with Tariyani P.S. Case No.132 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.
