JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2016 The present application has been filed for modification of the order dated 27.08.2015 passed in Cr. Misc. No. 38733 of 2015 to the extent that petitioner is not able to make payment of Rs. 1500/- per month as maintenance to the informant.
It is submitted by learned counsel for the petitioner that petitioner being husband of the informant is ready to keep the informant with dignity and honour. It is submitted by learned counsel for the informant that informant is ready to accept the offer of the petitioner though she refused to accept the offer earlier before learned Court below as has been stipulated in para 11 of the petition which reads as follows:- "That the petitioner is ready
Patna High Court Cr.Misc. No.3632 of 2016 (3) dt.22-06-2016 2/2 to keep the informant with full dignity and honour and in fact the informant herself refused to live with petitioner which is apparent from the order sheet of Sessions Judge"
Since the order was passed with the consent of the petitioner, this Court is not inclined to modify the order. However, in view of the present stand of both the parties, let learned Court below consider to grant provisional bail to the petitioner, if the issue is reconciled between the parties.
Accordingly the modification application is disposed of in connection with Rohtas P.S. Case No. 70 of 2015, pending in the Court of learned Sub-Divisional Judicial Magistrate, Dehri-on-sone, Rohtas.
